Q. We have another City Recorder?

A. That is right.

Q. Will you file that warrant as Exhibit 1 to your testimony?

A. Yes sir.

Q. Does that look like the gun?

A. Yes sir that is the gun.

Q. You don't know where this gun came from?

A. It was brought to the jail to me by Clyde Hyatt. He said it came out of the pocket of the car.

Q. Where is Clyde now?

A. He is in bed.

Q. Is he able to be out?

A. He has a broken hip.

Q. What did you do when you got away from out there?

A. I come to the courthosue. I met George Tallent, the sheriff of this county.

Q. Did you surrender to him?

A. I did. I told him what I had done. I went on to the jail with Joe Harrill.

Q. You surrendered your pistol?

A. The mayor of the town overtook me - after I went to the jail I came back out and started to talk to Frank Lowry - and

the mayor of the town come down and demanded the pistol. I unloaded it and gave it to him.

Q. I believe Frank Lowry was at that time an alderman of the town?

A. That is right.

Q. You had never had any previous difficulty with Rucker?

A. Never had. Never had a short word with him.
